Rules for buying and selling goods in the SAUNASUP.COM e-shop
  1. Definitions

1.1.Seller - a natural or legal person specified in the order of Goods, whose goods are sold on the WWW.SAUNASUP.COM website in accordance with these Rules and who is responsible for the execution of the order placed by the Buyer. The details of the Seller shall be indicated in the "About Us" section.

1.2. SAUNASUP.COM – tinklapis, esantis adresu WWW.SAUNASUP.COM, kuriame yra parduodamos Pardavėjo prekės, kurį administruoja Lietuvos Respublikos VĮ „Registrų centras“, Juridinių asmenų registro Vilniaus filiale įregistruotas privatusis juridinis asmuo Sauna world, MB, juridinio asmens kodas 307447804,  registruotos buveinės adresas J. Lukšos g. 14, Garliava, Kauno r., korespondencijos adresas J. Lukšos g. 14, Garliava, Kauno r. (toliau – UAB „Asauto“), parduotuvė Vytauto g. 67, Garliava, Kauno r.

1.3.Buyer - 1) a natural person of legal capacity, i.e. a person who has reached the age of majority and whose legal capacity has not been restricted by a court order; 2) a minor aged between fourteen and eighteen years who has the consent of his/her parents or guardians; 3) a legal person.

1.4 The Parties are the Buyer and the Seller together.

1.5 Personal data means any information relating to an identified or identifiable natural person (data subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data and an online identifier, or to one or more factors specific to the natural person's physical, physiological, genetic, mental, economic, cultural or social identity.

1.6 "Rules" means these "Rules for the Purchase and Sale of Goods in the SAUNASUP.COM e-shop", which shall apply to every purchase made by the Buyer on SAUNASUP.COM and to every Purchase and Sale Agreement concluded between the Buyer and the Seller.

1.7 Account - the result of the Buyer's registration on SAUNASUP.COM on the basis of the Terms and Conditions, which results in the creation of a personal account of the Buyer, which stores his/her personal data and the history of orders.

1.8. Privatumo politika – Sauna world, MB patvirtintas dokumentas, kuriame yra numatytos pagrindinės Asmens duomenų rinkimo, kaupimo, tvarkymo ir laikymo taisyklės, naudojantis SAUNASUP.COM. Prieš įsigyjant prekes ir sudarant šią sutartį su Pardavėju, Pirkėjas turi atidžiai susipažinti su Pardavėjo taikoma asmens duomenų tvarkymo politika.

1.9 Contract - the contract of sale of the relevant Goods between the Buyer and the Seller, which shall be deemed to be concluded from the time of placing the Order. The terms of each Contract entered into between the Buyer and the Seller shall be deemed to be identical to the terms of the Regulations in force at the time of the placing of the Order and such Contracts shall always be enforceable by the parties in accordance with the Regulations in force at the time of the placing of the Order.

1.10 "Order" means an order for Goods specifying the Goods which the Buyer wishes to purchase from the Seller, as specified in the same order.

  1. General provisions

2.1 The Buyer confirms the Terms and Conditions by reading them and by ticking the box next to the statement "I have read and agree to the Terms and Conditions of Sale and Purchase". The Terms and Conditions thus approved shall be a binding legal document for the Parties, which shall determine the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the Goods and payment for them, the procedure for the delivery and return of the Goods, the liability of the Parties, and any other conditions relating to the purchase - sale of the Goods.

2.2 By creating an account on SAUNASUP.COM, the Customer accepts the Terms and Conditions during the first registration. If the Buyer approves the Terms and Conditions at the time of the first registration (account creation), the Terms and Conditions shall apply to all purchases made by the Buyer and to all Contracts concluded with the Seller prior to the publication of updated Terms and Conditions. After the update of the Rules, they shall apply from the moment of their publication on SAUNASUP.COM, and the Buyer shall be informed of the update of the Rules in accordance with the procedure provided for in Clause 2.4 of the Rules.

2.3 Only Buyers, as defined in Clause 1.3 of the Terms and Conditions, shall be entitled to make purchases on SAUNASUP.COM. By accepting the Terms and Conditions and being familiar with the Privacy Policy (Clause 2.4 of the Terms and Conditions) and the SAUNASUP.COM Terms of Use, the Buyer confirms that he/she has the right to purchase the goods.

2.4. Pasikeitus rinkos sąlygoms ar esant Lietuvos Respublikos teisės aktuose numatytoms aplinkybėms, Sauna world, MB turi teisę pakeisti, taisyti ar papildyti Taisykles. Apie tai Pirkėjai bus informuojami prisijungę prie Paskyros arba SAUNASUP.COM arba formuodami prekių krepšelį, tačiau visais atvejais, po Taisyklių atnaujinimo.

2.5. Pirkėjas privalo susipažinti su Sauna world, MB patvirtinta ir viešai paskelbta Privatumo politika. Pirkėjo Asmens duomenys bus tvarkomi Pardavėjo prisiimtais saugumo įsipareigojimais dėl asmens duomenų saugumo užtikrinimo.

2.6 Where the Seller has the right or obligation to provide information or documents to the Buyer by email, it shall in all cases be the Buyer's responsibility to provide the Seller with a valid email address belonging to the Buyer.

  1. Ordering, buying - selling

3.1 The Buyer may order goods on SAUNASUP.COM by choosing one of the following methods:

3.1.1. by registering online at SAUNASUP.COM (by entering your registration name and password);

3.1.2. without registering online with SAUNASUP.COM;

3.1.3. telephone;

3.1.4. Sauna world, MB buveinėje.

3.2.When ordering goods by one of the methods specified in Clauses 3.1.1.1 - 3.1.2 of the Rules, the Buyer must specify in the relevant information fields provided in the SAUNASUP.COM system the Personal Data necessary for the proper execution of the order, which are processed by the SAUNASUP.COM in accordance with the procedure provided for by the Privacy Policy.

3.3.Orders for goods placed by telephone or in the Stores shall be executed in accordance with the procedure set out in the Rules and shall be subject to the provisions of the Privacy Policy. By placing an order, the Buyer agrees to the Terms and Conditions and their application.

3.4 When the Buyer, having selected the goods or services to be purchased and having formed a shopping cart, has completed all the steps of the order, the last of which is the selection and confirmation of the method of payment, it shall be deemed that a legal relationship of sale and purchase has been established and a contract of sale and purchase has been concluded between the Seller and the Buyer. The Buyer shall be informed of the order confirmation by means of a notification to the e-mail address indicated by the Buyer. The Seller shall send the Buyer a link to the applicable Terms and Conditions together with the order confirmation to the e-mail address indicated by the Buyer.

3.5. Pirkėjo užsakytos prekės instrukcija lietuvių kalba pateikiama ne vėliau nei prekės pristatymo metu prekės aprašyme pateiktoje internetinėje nuorodoje arba Pirkėjo nurodytu elektroninio pašto adresu arba kartu su įsigyta preke. Visa esminė informacija apie prekę ir jos savybes yra pateikiama prekės aprašyme SAUNASUP.COM. Įsigyjant prekes fizinėje Sauna world, MB parduotuvėje, prekės instrukcija, jeigu ji reikalinga atsižvelgiant į prekės pobūdį, bus pateikiama kartu su preke.

3.6 Each Buyer's order shall be stored in the Seller's database in accordance with their privacy policy.

  1. Buyer's rights

4.1 The Customer shall have the right to purchase goods and order services on SAUNASUP.COM in accordance with the procedures set out in these Terms and Conditions.

4.2 The Buyer shall have the right to cancel the order in accordance with the procedure set out in these Terms and Conditions.

4.3 The Buyer shall have the right to withdraw from the Contract in accordance with the procedures set out in these Terms and Conditions.

4.4 The Buyer shall have the right to exchange or return the purchased goods in accordance with the procedure set out in the Regulations.

4.5 The Buyer shall have other rights as set out in these Rules, the Privacy Policy, the SAUNASUP.COM Terms of Use, and the legislation of the Republic of Lithuania.

  1. Obligations of the buyer

5.1.The Buyer, using SAUNASUP.COM, is obliged to fulfill his/her obligations, to comply with these Terms and Conditions, the Privacy Policy, the rules of use of SAUNASUP.COM, other terms and conditions expressly specified by SAUNASUP.COM, and not to violate the legislation of the Republic of Lithuania.

5.2 The Buyer shall pay for and accept the goods or services ordered in accordance with these Terms and Conditions. If the Buyer chooses to collect the goods from the Shop, the Buyer must collect the goods within the time limits set out in the Terms and Conditions.

  1. Seller's rights

6.1. Pardavėjas ir Sauna world, MB turi teisę iš anksto neįspėjęs Pirkėjo anuliuoti jo užsakymą, jeigu Pirkėjas, pasirinkęs Taisyklių 8.2.1 ar 8.2.2 punktuose numatytus apmokėjimo būdus, nesumoka už prekes per 5 (penkias) darbo dienas.

6.2 Where the Buyer chooses the method of payment provided for in Clause 8.2.3 of the Terms and Conditions, the Seller shall have the right to contact the Buyer using the details provided in the order in the event of any uncertainty regarding the information provided in the order. In such case, the delivery period shall commence from the date of contact with the Buyer. The Buyer's order may be cancelled without prior notice if: i) the Seller is unable to contact the Buyer within 3 (three) working days after the order has been placed, or ii) the Buyer fails to provide the Seller with the requested information within the time limit specified by the Seller, or iii) the Buyer fails to provide the Seller with consent for the verification of the Buyer's personal data.

  1. Seller's obligations

7.1 The Seller undertakes to execute the Buyer's orders in accordance with the procedures set out in these Terms and Conditions and to communicate with the Buyer electronically (where the order has been placed by the method set out in Clause 3.1.1) or by the Buyer's contact details provided by the Buyer (where the order has been placed by one of the methods set out in Clauses 3.1.2 to 3.1.4).

7.2.The Seller undertakes to provide the Buyer with the information set out in Article 6.228-7 of the Civil Code of the Republic of Lithuania in a clear and comprehensible manner in the SAUNASUP.COM system.

7.3.The Seller undertakes to respect the Buyer's privacy and to process the Buyer's Personal Data only in accordance with the Rules, Privacy Policy, SAUNASUP.COM Terms of Use and the legislation of the Republic of Lithuania and the European Union.

7.4 The Seller undertakes to inform the Buyer prior to the placing of the order of the suspension or termination of the SAUNASUP.COM functions that are essential for the execution of the order. The provision of the information in the SAUNASUP.COM Account or on the SAUNASUP.COM e-commerce website shall be deemed to be adequate notification. When the Buyer's order has already been accepted for execution, the Buyer shall be informed of the suspension or termination of the SAUNASUP.COM functions relevant for the execution of this order by one of the contact details provided by the Buyer (by telephone, by SMS message or by e-mail).

7.5 Subject to the Terms and Conditions, the Seller undertakes to deliver the Goods ordered by the Buyer and to accept the Buyer's returns.

7.6 In exceptional cases, under objectively justified circumstances beyond the Seller's prior foreseeability and control, delivery of the Goods may be delayed or made impossible. In such a case, the Seller undertakes to immediately contact the Buyer regarding the possibility of further execution of his/her order, informing him/her thereof by one of the contact details provided by the Buyer (by phone, by SMS or by e-mail). If the Buyer does not agree with the information provided, the Seller undertakes to immediately refund the Buyer the money paid by the Buyer within a maximum period of 5 days in the case of prepayment, and to cancel the order in all cases.

7.7 In the event that, within 3 (three) working days of the submission of the offer, the Buyer has confirmed, through one of the contacts indicated on the SAUNASUP.COM e-commerce website, that he/she agrees to exchange the product for another product, the Seller undertakes to compensate the difference in price.

7.8.The Seller, disagreeing with the Buyer's requirements, shall provide the Buyer with a detailed reasoned written response within 14 (fourteen) calendar days from the date of receipt of the Buyer's request, unless otherwise provided for by the laws of the Republic of Lithuania and the European Union.

7.9.The Seller undertakes to fulfil other obligations imposed on the Seller by the Rules and the legislation of the Republic of Lithuania.

  1. Prices, payment procedures and terms

8.1 The prices of the goods on SAUNASUP.COM shall be quoted in Euro, including the VAT rate applicable at the time in accordance with the legislation in force and other taxes, if any.

8.2 The Buyer may pay for the ordered goods by one of the following methods (the choice may be limited, so the final list of payment methods applicable to the respective order is specified in the respective order):

8.2.1. through electronic banking;

8.2.2. by bank transfer;

8.2.3. in cash or by bank card at the time of delivery/collection;

8.2.4. in any other way specified on the SAUNASUP.COM website.

8.3 When the Seller receives payment for the Goods or confirmation of the financing of the purchase (where such method of payment is applicable and where the Buyer has chosen the method of payment set out in Clauses 8.2.4 to 8.2.5 of the Conditions), the order for the Goods shall be confirmed.

8.4 By accepting the Terms and Conditions, the Buyer agrees that the documents of purchase of the Goods - the VAT invoices, which are also the documents of warranty for the Goods - may be provided to the Buyer physically together with the Goods, or electronically to the e-mail address specified by the Buyer immediately after the order has been completed. The VAT invoices shall state the details of the Seller, the goods selected, the quantity, the discounts granted, the final price of the goods, including all taxes, the other services purchased, and any other information required by the accounting legislation.

8.5 VAT invoices for goods purchased by the Buyer may also be placed in the Buyer's Account. Once the Buyer has placed an order, the Buyer will be able to view and print the order sheet - the pre-paid invoice.

8.6 The price of the Goods may change after the Seller has confirmed the order only in exceptional cases due to objective material reasons beyond the Seller's control (subject to proof of such reasons). If the reasons for the price change are justified and in such case the Buyer does not agree to purchase the goods at the new price, the Buyer may cancel the order by informing the Seller within 2 (two) working days at the contacts indicated on the SAUNASUP.COM e-commerce website. In the event of cancellation of an order in accordance with the procedure set out in this clause, the Seller undertakes to reimburse the Buyer for all amounts paid by the Buyer in respect of such cancelled order. The validity of the reasons for changing the price shall be assessed on a case-by-case basis.

8.7 If the Customer has placed several items in the basket, the Customer's basket cannot be split and a single order is formed. In the case of each individual order, the price of the additional services (e.g. delivery, deposit, etc.) per order shall be broken down accordingly for each individual order, and the prices for the services indicated in the description of the specific product may therefore differ when orders are delivered together.

  1. Delivery of goods

9.1 When ordering Goods, the Buyer may choose one of the methods of delivery of the Goods specified in the particular order for the Goods sold by the Seller.

9.2 If the Buyer chooses a home delivery service at the time of order:

9.2.1 The Buyer undertakes to specify the exact place of delivery.

9.2.2 The Buyer undertakes to accept the Goods himself. A valid proof of identity (identity card, passport or new driving licence) must be presented at the time of acceptance. If the Buyer does not collect the goods himself, although the goods have been delivered to the address indicated by the Buyer, the Seller shall be entitled to hand over the goods to another person at the address indicated by the Buyer and the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong person.

9.2.3 The Goods shall be delivered by the Seller or its authorised representative.

9.2.4 The home delivery service fee does not include the delivery of the ordered goods to the building, which can be ordered additionally.

9.3 If the Buyer chooses to collect the Goods from third party collection points at the time of ordering, the Buyer shall collect the Goods in accordance with the separate terms and conditions set by these service providers, which shall be notified to the Buyer by the third party by electronic means at the time of the order.

9.4 The Buyer may collect the Goods free of charge from the Shop. If the Buyer chooses this method at the time of placing the order:

9.4.1.The ordered goods must be collected no later than within 5 (five) working days from the date on which the Seller has informed the Buyer by e-mail that the goods are available for collection.

9.4.2 Goods may only be collected by the person who placed the order or by the person specified at the time of placing the order. When collecting the Goods, it is necessary to carry and, at the request of the Seller's representative, to present a valid identity document (identity card, passport or new driving licence).

9.5 If the Buyer chooses to have the Goods delivered to a post office / parcel terminal at the time of placing the order:

9.5.1. goods weighing less than 30 kg may be collected from post offices / parcel self-service terminals. Goods heavier than 30 kg shall not be delivered to Post Offices or Parcel Terminals.

9.5.2. the Buyer shall collect parcels from third party post offices / parcel self-service terminals in accordance with the separate terms and conditions set by the providers of such post offices / parcel self-service terminals, which shall be communicated to the Buyer by the third party by means of electronic communication at the time of execution of the order.

9.6 In exceptional cases, the delivery of the Goods may be delayed due to unforeseen circumstances beyond the Seller's control and not reasonably foreseeable at the time of the conclusion of the contract of purchase and sale. In such a case, the Seller undertakes to contact the Buyer immediately to agree on the terms and conditions for delivery of the goods.

9.7 The Seller shall be exempt from liability for breach of the time limits for delivery of the Goods if the Goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties unrelated and/or independent of the Seller, or due to circumstances beyond the Buyer's control.

9.8. Prekių pateikimo Pirkėjui metu Pirkėjas privalo kartu su kurjeriu, o prekių fizinio atsiėmimo Parduotuvėje atveju – su Pardavėjo atstovu, patikrinti siuntos ir prekės (-ių) būklę bei pasirašyti siuntos perdavimo-priėmimo dokumentą. Pirkėjui pasirašius siuntos perdavimo-priėmimo dokumente, laikoma, kad prekė yra perduota tinkamos būklės, be pažeidimų, kurių atsiradimo pagrindas priskirtinas ne gamykliniam brokui, bei prekės (-ių) komplektacijos neatitikimų (tokių, kuriuos galima nustatyti išorinės prekių apžiūros metu) nėra. Pastebėjęs, kad pateiktos prekės pakuotė pažeista (suglamžyta, šlapia ar kitaip išoriškai pažeista), prekė(-ės) yra pažeista (-os) ir / ar prekė (-ės) yra netinkamos komplektacijos, Pirkėjas privalo tai pažymėti prekės perdavimo-priėmimo dokumente bei, dalyvaujant kurjeriui, o prekių fizinio atsiėmimo Parduotuvėje atveju – Sauna world, MB atstovui, surašyti laisvos formos siuntos ir / ar prekės (-ių) pažeidimo/neatitikimų aktą. Pirkėjui neatlikus šių veiksmų, Pardavėjas yra atleidžiamas nuo atsakomybės dėl prekių pažeidimų, kai tokių pažeidimų atsiradimo pagrindas nėra gamyklinis brokas bei dėl prekių komplektacijos neatitikimų tik tuomet, jei šiuos neatitikimus galima nustatyti išorinės prekių apžiūros metu.

9.9 The risk of accidental loss or damage to the Goods shall pass to the Buyer from the time the Goods are handed over to the Buyer.

9.10.If, in accordance with Clauses 9.2 to 9.5 of the Regulations, the Buyer fails to collect the Goods within the time limit or fails to deliver them to the Buyer and the Buyer has paid for the Goods and their delivery, the Representatives shall contact the Buyer to arrange an alternative time and/or method of delivery. If the Buyer still does not collect the goods or fails to deliver them, such goods shall be returned to the Seller, the order shall be cancelled and the Buyer shall be refunded the money paid for the goods, less any bank charges applicable to the Seller for the bank transfers made and the delivery charge, if applicable.

9.11.If, in accordance with Clauses 9.2 to 9.5 of the Rules, the Buyer fails to collect the Goods within the time limit or fails to deliver them to the Buyer and the Buyer has not paid for the Goods, such Goods shall be returned to the Seller and the order cancelled.

  1. Guarantee of the quality of the goods and their shelf life

10.1 The characteristics of each item sold by the Seller on SAUNASUP.COM are set out in the description of each item.

10.2. the goods offered for purchase by the Seller are of satisfactory quality. The goods are in conformity with the contract of sale for consumer purchase if:

10.2.1. the product corresponds to the description provided by the Seller and has the same characteristics as the product that the Seller has provided as a sample or model in the promotion of that product on SAUNASUP.COM;

10.2.2. the product is suitable for the use for which the product is normally used;

10.2.3. the item meets the quality characteristics that are generally characteristic of goods of the same nature and that the Buyer can reasonably expect from the nature of the item and from the statements made publicly by the manufacturer of the item, its representative or the seller, including advertising and labelling of the item, as to the particular characteristics of the item.

10.3 The Seller shall not be liable for the fact that the size, shape, shade or other parameters of the goods sold on SAUNASUP.COM website may not correspond to the actual size, shape, shade or other parameters of the goods, due to the characteristics of the screen of the device used by the Customer, or for any other technical reasons beyond the control of the Seller. Photographs of the Goods are for illustrative purposes only and are exemplary. The shades, inscriptions, parameters, dimensions, sizes, functions and/or any other features of the original products may appear differently than in reality due to their visual characteristics, so please refer to the characteristics of the goods as indicated in the descriptions of the goods. The Buyer is advised to read the product description.

10.4 The Seller shall provide a guarantee of quality for different types of goods for a certain period of time, the specific term and other conditions of which shall be specified in the descriptions of such goods or together with the invoice of the goods corresponding to the guarantee document.

10.5 The Seller's guarantee of quality does not limit or restrict the rights of consumers under the law in the event of the purchase of a product or service of inadequate quality.

10.6 The Seller does not provide after-sales maintenance services for the Goods (except for simple checks on the functioning of the Goods that do not require special knowledge):

10.6.1. if the centre(s) providing warranty service is/are located outside the Republic of Lithuania, the Seller shall arrange for the Goods to be sent to such centre(s);

10.6.2. if the centre(s) providing after-sales service is (are) located in the Republic of Lithuania, the Purchaser shall be directed to such centre(s).

10.7 If the Buyer wishes to take advantage of the quality guarantee in respect of the media purchased by the Buyer, the Buyer is responsible for the preservation of the personal information on the device, i.e. the information contained on the media is not covered by the guarantee. The data on the device submitted for repair will normally be deleted, unless the Buyer requests the data to be retained and it is technically feasible to do so. The possibility of preserving the information contained in the media shall be discussed between the Buyer and the Seller on a case-by-case basis.

10.8 Where a period of fitness for use is prescribed by law in respect of particular goods, the Seller undertakes to sell such goods to the Buyer in such a way that the Buyer is given a realistic opportunity to make use of such goods before the expiry of the period of fitness for use.

  1. Right of withdrawal and return of goods of satisfactory quality

11.1 The right to withdraw from the contract of sale after the purchase of goods on the SAUNASUP.COM website:

11.1.1 The Buyer shall have the right to withdraw from the distance purchase contract within 14 (fourteen) days without stating a reason by notifying the Seller in accordance with the procedure set out in these Rules. Please note that the Buyer may not exercise this right in the event of conclusion of one of the contracts listed in Article 6.228-10(2) of the Civil Code of the Republic of Lithuania for:

11.1.1.1.1. goods which are made to the Buyer's specifications or which are expressly tailored to the Buyer's personal requirements;

11.1.1.2. goods that are perishable or have a short shelf life;

11.1.1.3. if the packaged goods are no longer returnable for health or hygiene reasons and have been unpacked after delivery (e.g. protective masks, visors, underwear, etc.);

11.1.1.4. goods which, by their nature, are indistinguishable from other goods after delivery;

11.1.1.5. goods purchased under contracts under which the Buyer has made a specific request to the Seller for a visit to carry out urgent repairs or maintenance. If, in this case, the Seller provides more additional services than the Buyer has specifically requested or sells more additional goods than are necessary to carry out the repairs or maintenance, the right of withdrawal shall apply to those additional services or goods;

11.1.1.6 in respect of services which have been fully performed for the Buyer, provided that the Buyer has expressly agreed and acknowledged, prior to the performance of the services, that it will not have the right to withdraw from the contract once the Seller has fully performed the contract.

11.2. the Seller's additional money-back guarantee:

11.2.1. the Seller's additional money-back guarantee is only applicable to goods purchased by SAUNASUP.COM registered users using a registered SAUNASUP.COM account or

11.2.2.After a period of 14 (fourteen) but not more than 30 (thirty) days from the date of delivery or collection of the goods, the Buyer shall be entitled to benefit from the Seller's additional money-back guarantee to the Buyer, provided that all returned goods are in the authentic labels, protective bags and the original packaging, and that the disposable packaging is not damaged, that is to say, the goods are not in the same condition as when sold. In all cases, the additional money-back guarantee (if applicable by the Seller in respect of the goods in question) will be enforced "mutatis mutandis" in accordance with the provisions of Clauses 11.2.2 to 11.2.5 and 11.7 of the Conditions.

11.2.3 If the notification is made within 14 (fourteen) calendar days from the date of delivery of the Goods to the Buyer, the provisions of Clause 11.1 of the Conditions shall apply.

11.2.4 In all cases, the Goods must be returned to the Seller before the expiry of the period of such warranty from the date of delivery or collection.

11.2.5 The Seller's additional money-back guarantee is not available for the following goods:

11.2.5.1. Gift vouchers;

11.2.5.2. packaged goods which have been unpacked after delivery and which are unsuitable for return for health or hygiene reasons;

11.2.5.5. goods which have been made to the Buyer's individual order or which are obviously tailored to the Buyer's needs, or which, by their very nature, cannot be returned after they have been delivered to the Buyer due to loss of merchantability, perishability or expiry;

11.2.5.6. goods in the category "Protective, disinfecting and medical supplies";

11.3.Upon exercising the rights set out in Clause 11.1 of the Terms and Conditions, the Buyer shall be refunded: the price of the goods, the administrative fee, if applicable, and the delivery costs (the costs of returning the goods shall not be returned).

11.4 If the Buyer has purchased a set of goods at SAUNASUP.COM, the Buyer must return the entire set of goods to the Seller, i.e. the Buyer may only exercise his/her rights of return in respect of all the goods contained in the set.

11.5 If the Buyer has chosen a delivery method other than the cheapest delivery method offered by the Seller, the difference between the Buyer's chosen delivery method and the cheapest delivery method shall not be refunded to the Buyer.

11.6.The Buyer shall bear all costs and risks associated with the return of the goods referred to in Clause 11.2 of the Terms and Conditions and/or quality goods. In all cases, the Goods must be returned to the Seller before the expiry of the return period for quality Goods calculated from the date of delivery or collection.

11.7 The money shall be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notification of the Buyer's wish to exercise one of the rights provided for in Clauses 11.1-11.3 of the Terms and Conditions, and in case the Goods have not been returned by the Buyer to the Seller, the time limit provided for in this Clause shall be calculated as from the date of the Goods' return to the Seller.

11.8 Upon receipt of the Goods referred to in Clause 11.3 of these Conditions, the Seller undertakes to replace them only with other Goods of the same shape, size, colour, model or completeness specified by the Buyer. If the Seller does not have suitable goods for replacement, the Seller shall refund the money paid for the goods to the Buyer.

  1. Rectifying defects in goods

12.1.The defects of the sold goods shall be eliminated, the defective goods shall be replaced or returned in accordance with the procedure set out in the Rules and taking into account the requirements of the legislation of the Republic of Lithuania.

12.2 If the Buyer has purchased goods of inadequate quality, the Buyer shall be entitled to one of the following remedies:

12.2.1. the Seller to remedy the defects in the Goods, free of charge, within a reasonable period of time, if the defects can be remedied;

12.2.2. to reduce the purchase price accordingly;

12.2.3. to have the goods replaced with goods of equivalent quality, unless the defects are minor or caused by the Buyer;

12.2.4. refund the price paid and withdraw from the contract of sale where the sale of goods of inadequate quality constitutes a material breach of the order.

12.3 If the goods do not comply with the quality requirements, the Buyer shall be entitled in the first instance to demand that the goods are of the correct quality, failing which the Buyer shall be entitled to demand a proportionate reduction in the price of the goods or to terminate the sales contract unilaterally. In order to ensure the proper quality of the goods, the Buyer has the right to choose to require the goods to be repaired or to require their replacement, unless it would be impossible to meet the requirement or would cause the Seller to incur disproportionate costs in relation to the costs of meeting the other requirement, taking into account all the circumstances, including:

1) the value of the goods if they were not defective;

2) the significance of the defect (non-conformity);

3) whether the application of a different requirement would cause any inconvenience to the Buyer.

12.4 The Buyer shall only be entitled to claim a proportionate reduction in the price of the Goods or to terminate the contract of sale if:

12.4.1. the Seller has not repaired or replaced the Goods, or the Seller has refused to cover the cost of returning the Goods or the cost of removing and installing the Goods when the Goods have been properly installed (installed, fitted or installed), or the Seller has refused to ensure the proper quality of the Goods;

12.4.2. the defect in the Goods occurred despite the Seller's attempts to ensure the quality of the Goods;

12.4.3. the defect in the goods is material;

12.4.4. the Seller has stated or it is clear from the circumstances that it will not ensure the proper quality of the goods within a reasonable period of time or that this will cause serious inconvenience to the Buyer.

12.5 The Buyer shall not be entitled to terminate the contract of sale if the defect in the goods is minor.

12.6 In order to return the Goods, the Buyer must comply with the following conditions:

12.6.2. provide the document of purchase of the goods and the document confirming the guarantee (if issued);

12.6.3. make a free-form application and submit it to the Seller.

12.7 The Buyer may exercise the right to return goods of unsatisfactory quality within the quality guarantee period set out in the document of purchase of the goods, as specified by the Seller from whom the Buyer purchased the goods. In the case of consumer purchases, the guarantee of the quality of the goods shall in all cases be at least 2 years from the date of receipt of the goods.

12.8 The Buyer shall pay for the cost of delivery and the cost of returning the goods. If the Goods are returned for faulty quality, the Seller shall reimburse the Buyer for the costs of delivery and return.

12.9 The money shall be refunded to the Buyer immediately, but no later than 5 days after the Buyer has returned the goods to the Seller and the Seller has determined the quality of the goods.

12.10. No refunds will be given for goods that have been damaged intentionally or negligently (by chemicals, water, open flames, high temperatures, sharp objects, etc.), or if the rules of use or storage of the goods have been violated, or if the goods have been used improperly or for an improper purpose.

12.11. Separate rules for the return of goods of unsatisfactory quality by the Seller may be set out in the warranty documents accompanying the goods. Such return policies of the Seller shall apply to the extent that they are not inconsistent with these Conditions. In the event of any inconsistency between these Conditions and the rules applied by the relevant Seller, these Conditions shall prevail.

  1. Replacement and return of goods if the wrong goods are delivered

13.1. Pinigai Pirkėjui grąžinami nedelsiant, bet ne vėliau kaip per 5 d.d. po to, kai Pardavėjas gavo Pirkėjo pranešimą apie tai, kad buvo gautos ne tos prekės, o jei Prekė Pirkėjo nėra grąžinta Pardavėjui, šiame punkte numatytas terminas pradedamas skaičiuoti nuo Prekės grąžinimo Pardavėjui dienos.

  1. General rules on returning goods and money

14.1 The Buyer, wishing to withdraw from the concluded contract of sale of goods, or wishing to return the goods (regardless of the reason for return), may inform the Seller directly, by filling in the appropriate form, in the manner specified in his Account, by e-mail info@saunasup.comsup.com, by telephone +370 601 50011, and deliver the goods directly to the Seller.

14.2 All gifts that were provided with the purchased goods must be returned at the same time as the return of the goods purchased by the Customer, unless the purchased goods are returned due to a defect in their quality and the gifts provided with them have, by their nature, been consumed within the period from the date of purchase of the goods to the date of discovery of the defect in the goods, or the shelf-life of such gifts has expired.

14.3 When returning the Goods, the Buyer must provide the sender's address and pack the Goods properly to prevent damage during shipment. Goods are considered to be properly packaged when they are enclosed in additional outer packaging (boxed, bagged, wrapped in paper, etc.) and the packaging is tightly closed (e.g. sealed). If the returned goods are fragile or fragile, they must be further protected from impact by wrapping them in several layers of paper, cloth or bubble wrap and then placing them in the outer packaging of the parcel (box, bag, paper). The Seller shall not be liable for parcels sent by the Buyer which have been incorrectly packed, incorrectly addressed, or lost or damaged on return to the Seller.

14.4 Money for the Goods shall be refunded to the Buyer in the same manner as the Buyer paid for the Goods at the time of purchase, unless the Buyer and the Seller agree otherwise. The Buyer shall in all cases have the right to request that the money be refunded to the bank account specified by the Buyer.

14.5 A Buyer wishing to make use of the additional money-back guarantee set out in the Terms and Conditions must specify the goods to be returned and the reason for the return.

  1. Responsibility

15.1 The Buyer shall be liable for any unlawful acts committed through the use of SAUNASUP.COM.

15.2 Once registered, the Buyer is responsible for the storage and/or transfer of his/her login details to third parties. If the services provided by SAUNASUP.COM are used by a third party who has logged into SAUNASUP.COM using the Buyer's login data, the Seller shall consider this person as the Buyer.

15.3 The Seller shall be exempt from any liability in cases where the loss is caused by the Buyer's failure to read these Terms and Conditions, the Privacy Policy, the SAUNASUP.COM Terms and Conditions of Use, without taking into account the Seller's recommendations and his/her own obligations, even though he/she had the opportunity to do so.

15.4 Where SAUNASUP.COM provides links to other third party websites, SAUNASUP.COM does not warrant that the information that can be accessed by clicking on these links (unless the Seller expressly states that clicking on a particular link will provide access to the features of the product offered to the Customer, and any other information about the product offered) is correct, complete or accurate.

  1. Exchange of information

16.1 All communication related to the purchase of goods through SAUNASUP.COM shall be made through the contacts indicated on the SAUNASUP.COM e-commerce website.

16.2.SAUNASUP.COM sends all notifications in accordance with these Rules and the Privacy Policy to the e-mail address specified by the Customer during registration or when ordering goods.

  1. Final provisions

17.1 These Terms and Conditions are made in accordance with the laws of the Republic of Lithuania.

17.2 The law of the Republic of Lithuania shall apply to relations arising under these Terms and Conditions.

17.3 All disagreements arising out of the application of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.

17.4 In case the Buyer does not agree with the Seller's response to the Buyer's written complaint, the Buyer (natural person, consumer) may submit his/her request/complaint regarding the goods purchased at SAUNASUP.COM to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 85 262 67 51, fax.
